PRIVACY POLICY AND DATA PROCESSING:
During the use of the BEYOND STORE by the USER, BEYOND will collect and store the information provided by USERS, under the terms of this instrument, along with information generated automatically, such as the characteristics of the access device, access records to the application (IP, with date and time), among others, of USERS, which will be stored in the database. The data collected from USERS by BEYOND through the use of the BEYOND STORE will be used to enable the purchase and delivery of BEYOND PRODUCTS. As well as for the purpose of improving USER navigation and statistics. The USER declares to understand, accept, and consent that all data collected through the BEYOND STORE be processed, in accordance with article 5, item X, of Law 13.709 of 2018, by BEYOND or by third parties, namely:
(i) AWS, which can be contacted through aws.amazon.com/pt/;
(ii) Wix, which can be contacted through pt.wix.com/;
(iii) Mercado Pago, which can be contacted through www.mercadopago.com.br;
All data provided by the USER to BEYOND through the use of the BEYOND STORE will be considered confidential by BEYOND, and BEYOND undertakes to make every effort to preserve the security of its systems in the storage of such data, complying with the security standards established in Decree No. 8.771/2016, such as:
(i) The use of market-standard methods to encrypt the collected data, as well as other standard forms of encryption, to ensure their inviolability;
(ii) The use of high-tech software to protect against unauthorized access to systems, which are considered controlled and secure environments;
(iii) Controlled access to personal data storage locations only by previously authorized and authenticated individuals, committed to the confidentiality of such data, including through the signing of a confidentiality agreement;
(iv) Application of access authentication mechanisms to records capable of individualizing the person responsible for the processing and access to data collected as a result of the use of the BEYOND STORE;
(v) Anonymization of USER data when shared with third parties not affiliated with BEYOND;
(vi) Maintenance of an inventory indicating the moment, duration, identity of the employee or person responsible for access, and the object file, based on connection and access records to applications, as determined in Article 13 of Decree No. 8.771/2016.
The data of USERS collected by BEYOND through the use of the BEYOND STORE may be shared with third parties in the cases related below:
(i) When necessary for the business activities of BEYOND and the companies of its economic group, in order to enable the provision of services offered through the BEYOND STORE.
In this case, BEYOND will share:
a. The USER's email address with Amazon AWS, in order to enable server storage of data collected through the BEYOND STORE;
b. The USER's first name, last name/legal name, CPF/CNPJ, complete address with Wix, in order to enable the creation of the necessary registration for the purchase of the BEYOND PRODUCT;
c. The USER's first name, last name/legal name, CPF/CNPJ, complete address, credit card number, expiration date, and security code with Mercado Pago for the purpose of conducting the payment transaction for the purchase of the BEYOND PRODUCT from the BEYOND STORE; and,
d. The USER's first name, last name/legal name, CPF/CNPJ, complete address with Correios for the purpose of shipping the BEYOND PRODUCT purchased from the BEYOND STORE.
(ii) For the protection of BEYOND's interests in case of conflicts, including in legal disputes;
(iii) In case of corporate transactions and changes involving BEYOND, in which case the transfer of data will be necessary for the continuity of the services offered through the BEYOND STORE;
(iv) Pursuant to a court order or at the request of administrative authorities with legal competence to request it.
BEYOND guarantees the USER, with regard to the processing of personal data, the following rights:
(i) Confirmation of the existence of the processing of their personal data;
(ii) Access to their data collected by the BEYOND STORE by requesting it at the email dados@beyond.dm;
(iii) Correction of their data, if they are incomplete, inaccurate, or outdated;
(iv) Blocking or deletion of unnecessary, excessive, or data processed in violation of applicable Brazilian law;
(v) Portability of personal data, for themselves or for a third party, upon the express request of the USER to BEYOND, through contato@beyond.dm;
(vi) Deletion of personal data processed with their consent, provided there is no legal requirement to keep them registered with BEYOND;
(vii) Obtaining information about public or private entities with which BEYOND has shared their data; and,
(viii) Information about the possibility and consequence of not providing the USER's consent.
The USER may send an email to contato@beyond.dm, indicating doubts and/or requests related to their personal data. BEYOND may delete the personal data collected from USERS:
(i) When the purpose for which they were collected is achieved, or when they are no longer necessary or relevant to achieve the purpose, as described in these Terms of Use and Privacy Policy;
(ii) When the USER revokes their consent, in cases where it is necessary, by requesting deletion to BEYOND via email at dados@beyond.dm; or,
(iii) If determined by a competent authority.
All members of the technical team, whether employees or third-party companies, will sign a confidentiality agreement, stating that they are obligated to keep all commercial, accounting, administrative, technological, infrastructural, technical, or any data disclosed mutually as a result of the maintenance of the operation and security of the BEYOND STORE, refraining from using them for their own benefit or that of third parties, undertaking to ensure that their partners, employees with employment contracts, and trusted third parties, informed of this obligation, also do so. The USER is aware and agrees that all their personal data provided in the BEYOND STORE will be collected and will remain in the possession of BEYOND for as long as the USER maintains an active registration in the BEYOND STORE, in order to enable the purchase of BEYOND PRODUCTS. The USER is aware and agrees that all interactions carried out in the BEYOND STORE generate a behavioral history, which will be collected and remain in the possession of BEYOND for as long as the USER maintains an active registration in the BEYOND STORE.
